客户N，去年6月18日签收的联邦技术移民，11月7日收到了Negative Eligibility Review (NER)，原因是分数不够。拒签信里有这么一句话：
You were assigned 11 points for your 2 years of full-time work experience, or the equivalent in part-time work, within the 10 years prior to the date your application was made, in accordance with R 80 of IRPA. Points were assigned for your work experience with 公司名 from 27 June 2007 to 26 June 2009. No points were assigned for your work experience with 公司名 from 26 June 2009 to 23 May 2014 because sufficient evidence that you performed a substantial number of the main duties of the occupation was not provided, as set out in the occupational description of NOC 5125.
这明显是错误的，虽然申请人的Primary NOC Code是5125，但是5125只要求1年的连续工作经验，而工作经验的分数，应该是由过去10年中所有NOC 0、A、B的工作加起来算的。事实上，客户有4年以上的1225的工作经验，这样加起来就够69分了。
遗憾的是，客户最初是DIY的，找到我们的时候，已经过了60天联邦法院的上诉期限了，于是我们只能帮客户和CIC沟通，我们先填了代理表，然后以移民顾问的口吻发信给CIO要求重新算分。
Actually, working from 26 June 2009 to 23 May 2014 in this company, Ms. N takes the position of Project Manager which conforms with main duties of NOC 1225 (Skill Level B). On the Part b), Question 12 of application form Schedule 3 – Economic Classes-Federal Skilled Workers, she also write clearly and definitely that the NOC Code for Project Manager is 1225. In accordance with IRPR 80 (2), points should be assigned for her work experience in this company from 26 June 2009 to 23 May 2014, and from 27 June 2007 to 23 May 2014. Ms. N had more than 6 years full-time work experience within the 10 years prior to the date her application was made, so she should be assigned 15 points for this in accordance with IRPR 80(1)(d). And Ms. N has obtained sufficient points to qualify for immigration to Canada, the minimum requirement being 67 points.
我们前后至少沟通了3次，4个月过去，发过去的信如石沉大海，一点回音也没有，然而到了6月8日，突然从CIO发来一封邮件：
Dear Sir/Madam
Please be advised your request for reconsideration has been forwarded to the appropriate person for action/review.
Thank you.
类似的邮件我们之前也见过，是转到Vegreville的境内大签申请要求重新考虑，一点消息也没有。
最后的反转剧情是，今天上午居然收到了Positive Eligibility Review (PER)，时隔7个月，客户的材料得以重审，发PER过来的，和当年拒签的签证官是同一个人。
说明移民局内部在明显违反移民法的事实面前，还是会有一些纠错机制，不是什么事情都要弄到上诉这一步，另外他们也没有因为“反正过了上诉期限”对我们置之不理。
